MEDELEM LTD — Terms and Conditions

1. Who we are

2. Who we sell to

medelem.com is a business-to-business shop. Accounts are opened for dealers, distributors, hospitals and clinics, and service companies. Registration is reviewed and approved before prices become visible and before an order can be placed. We do not sell to consumers.

3. Prices

Prices are not shown publicly. They become visible to approved account holders after signing in, or are given in answer to a request. All prices are in euro (EUR) and exclude VAT; VAT is added where the law requires it. A price is valid only for the quotation in which it was given.

4. Placing an order

Selecting products and sending a request is not yet a contract. A contract is formed when we confirm the order in writing by email. We may decline an order, for example when an item is unavailable or a delivery destination cannot be served.

5. Payment

Payment is by bank transfer in advance. Goods are dispatched after the funds have arrived in our account. Bank charges are borne by the payer.

6. Delivery

We deliver inside Bulgaria and internationally. Delivery inside Bulgaria is free of charge. For every other destination the carrier, the cost and the delivery time are agreed for each order before it is confirmed. Delivery times are estimates, not guarantees. Risk passes when the goods are handed to the carrier, unless agreed otherwise in writing.

7. The goods

We supply consumables and equipment for medical imaging — films, chemistry, cassettes, thermal paper and electrodes — intended for professional use by qualified personnel. Storage and handling conditions are those stated by the manufacturer on the product datasheet. We are a distributor, not the manufacturer.

8. Checking the goods on arrival

Check quantity and visible condition on delivery. Report visible damage or a shortage within 3 working days of receipt, with photographs, to info@medelem.com. Claims about visible damage made later cannot be verified.

9. Returns

The statutory right of withdrawal protects consumers and does not apply here, because we sell to businesses. Goods correctly supplied are taken back only by prior written agreement: unused, in the original sealed packaging, and at the buyer’s cost. Light-sensitive and sterile products cannot be returned once the packaging is opened.

10. Faulty or wrong goods

If goods are defective, or are not what was ordered, we replace them or refund them. Tell us within 14 days of discovering the problem and keep the batch number and the packaging.

11. Liability

We are liable for the goods we supply. We are not liable for the results of their use: choosing a product for a given device or procedure is the buyer’s decision, and the manufacturer’s specification prevails. Nothing in these terms limits liability that cannot lawfully be limited.

12. Governing law

Bulgarian law governs these terms. Disputes are heard by the competent court in Bulgaria, unless a mandatory rule requires otherwise.

13. Changes

We may change these terms. The version published here when your order is confirmed is the version that applies to that order.
